Please Read Carefully

By attending or participating in any experience provided by Honeypour LLC dba Vida Kitchen (“Vida Kitchen,” “we,” or “us”) — including private dining experiences, communal pre-fixe events, and on-site gatherings (the “Services”) — you acknowledge and agree to the following:

Assumption of Risk

You understand that participation in food- and event-based experiences involves inherent risks. These may include, but are not limited to, cuts, burns, slips or falls, allergic reactions, illness related to food or beverage consumption, or other injuries that may occur during or in connection with the Services. You voluntarily choose to participate and knowingly assume all risks associated with your attendance.

Health, Allergies & Personal Responsibility

You are responsible for your own health, safety, and well-being. This includes being aware of and disclosing any food allergies, dietary restrictions, sensitivities, or medical conditions prior to participating. Vida Kitchen is not responsible for any adverse effects related to conditions that were not disclosed in advance. If you have concerns about your ability to safely participate, you agree it is your responsibility to consult a medical professional before attending.

Release of Liability (California)

To the fullest extent permitted by California law, you agree to release, waive, and hold harmless Honeypour LLC dba Vida Kitchen, its owners, employees, contractors, agents, and representatives from any and all claims, demands, causes of action, injuries, illnesses, losses, or damages arising out of or related to your participation in the Services, including those resulting from the ordinary negligence of Vida Kitchen.

Vida Kitchen is not responsible for lost, stolen, or damaged personal property. This agreement is binding upon you and your heirs, personal representatives, successors, and assigns.

California Civil Code §1542 Waiver

You expressly waive the protections of California Civil Code Section 1542, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

You acknowledge that you may discover claims or facts in addition to or different from those now known or believed to be true, and you expressly waive any right to assert such claims.

Photo & Video Release

You understand that photos and videos may be taken during Vida Kitchen events. By participating, you grant Vida Kitchen permission to use your image, likeness, voice, or appearance in photographs or recordings for marketing, promotional, website, or social media purposes, without compensation or further approval.

If you prefer not to be photographed or recorded, you agree to notify Vida Kitchen staff prior to or during the event.

Governing Law & Venue

This agreement shall be governed by and interpreted in accordance with the laws of the State of California. Any dispute arising from this agreement shall be brought exclusively in a court of competent jurisdiction located in California.

Acknowledgment

By signing or participating, you confirm that you have read, understood, and voluntarily agree to this California Liability Waiver & Photo/Video Release, and that Honeypour LLC/Vida Kitchen is relying on this agreement in providing the Services.
